From June 19, 2026, traders who conclude distance contracts with consumers via online user interfaces must provide an electronic withdrawal function (“withdrawal button”).<\/p>

I. To whom does this obligation apply? <\/strong><\/p>

This affects all entrepreneurs in the B2C sector who conclude contracts for<\/p>

  • Online stores<\/li>
  • Apps<\/li>
  • Other online platforms<\/li><\/ul>

    conclude a contract. E-mails or messenger services (e.g. WhatsApp) are only included if they themselves serve as a contract conclusion or order interface. <\/p>

    II. What requirements apply to the provision of the revocation function?<\/strong><\/p>

    The revocation function must:<\/p>

    • easy to find and clearly highlighted (font size, contrast)<\/li>
    • Available without registration<\/li>
    • accessible from all relevant subpages<\/li>
    • “Button” not absolutely necessary – a clearly highlighted link is sufficient.<\/li><\/ul>

      III How does the revocation have to proceed technically? <\/strong><\/p>

      The legislator requires a two-stage procedure:<\/p>

      Step 1<\/strong>: Click on “Revoke contract” -> Forwarding to a form with<\/p>

      • Name of the consumer<\/li>
      • electronic contact details (e.g. e-mail)<\/li>
      • Contract or order number<\/li><\/ul>

        <\/p>

        A reason for revocation may not be mandatorily requested.<\/p>

        Step 2<\/strong>: separate confirmation (“Confirm revocation”)<\/p>

        After sending, a confirmation of receipt must be sent immediately on a durable medium (usually by e-mail).<\/p>

        IV. Meaning of “permanent availability of the function during the withdrawal period”?<\/strong><\/p>

        The withdrawal button must be available during the withdrawal period. According to the German explanatory memorandum, a permanent display is permitted for all consumers. Final clarification by the ECJ is still pending. <\/p>

        V. Risks in case of missing or incorrect “button”<\/strong><\/p>

        If the withdrawal instructions are incorrect, the withdrawal period does not begin to run; instead, the maximum withdrawal period of 12 months and 14 days applies. There is also a risk of breaches of competition law. <\/p>

        VI Practical tips<\/strong><\/p>

        1. the withdrawal button must be easily accessible and prominently placed at all times, even if the online platform through which the contract was concluded is not operated by the seller (such as eBay or Amazon Marketplace) – the platform operator must provide the technical equipment.<\/p>
