In the current issue of the trade journal Recht der Transportwirtschaft (RdTW, issue 5/2022) published Dr. Frank Wilting, member of the competence team Transport Law & Rail at TIGGES, made a comprehensive contribution on the topic of “Ukraine, Belarus and the use of rail freight wagons“. The war raging in Ukraine, but also the role of the political leadership of Belarus in this conflict, are keeping rail transport companies (RUs) and the lessors of rail freight wagons (wagons) busy with questions about usage and liability risks. Wagon lessors would like clarification as to whether they can legally prohibit or restrict the use of wagons in or on the borders of war and crisis zones. This article provides an insight into current problems and summarizes possible solutions.
